Welcome to Bloom Hosting
These Terms of Service ("Terms") govern your access to and use of Bloom Hosting services. By accessing or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, purchasing services, or accessing Bloom Hosting's infrastructure, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these Terms, you must not use our services. We reserve the right to refuse service to anyone for any reason at any time.
2. Service Description
Bloom Hosting provides a range of web hosting services including but not limited to:
- Shared Hosting: Web hosting on shared servers with allocated resources
- VPS Hosting: Virtual private servers with dedicated resources
- Dedicated Servers: Physical servers for exclusive use
- Cloud Hosting: Scalable cloud infrastructure solutions
- Domain Registration: Domain name registration and management
All services are provided "as is" and are subject to availability. We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service at all times.
3. Account Registration
3.1 Account Requirements
To use our services, you must:
- Be at least 18 years of age or have parental consent
- Provide accurate, current, and complete information
- Maintain and update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
3.2 Account Security
You are responsible for maintaining the security of your account credentials. Notify us immediately of any unauthorized access or security breach. Bloom Hosting will not be liable for any loss or damage arising from your failure to comply with security requirements.
4. Payment Terms
4.1 Billing Cycles
Services are billed in advance on a monthly, quarterly, semi-annual, or annual basis as selected during purchase. Billing begins immediately upon service activation.
4.2 Pricing
All prices are displayed in USD and are subject to change with 30 days notice. Price changes will not affect existing customers during their current billing cycle.
4.3 Payment Methods
We accept major credit cards (Visa, MasterCard, American Express), PayPal, and wire transfers for annual plans. All payments must be received before service activation.
4.4 Refund Policy
We offer a 30-day money-back guarantee on shared and VPS hosting plans. Refunds are not available for:
- Dedicated servers and cloud hosting
- Domain registrations and renewals
- Setup fees and administrative charges
- Accounts terminated for Terms violation
4.5 Late Payments
Accounts not paid within 7 days of the due date will be suspended. Services will be terminated after 14 days of non-payment. A $25 reactivation fee applies to suspended accounts.
5. Acceptable Use Policy
You agree not to use Bloom Hosting services for any unlawful or prohibited activities including:
5.1 Prohibited Content
- Illegal content, including child pornography or copyright infringement
- Malware, viruses, or other malicious code
- Phishing sites or fraudulent content
- Content promoting violence, terrorism, or hate speech
- Spam or unsolicited bulk email
5.2 Prohibited Activities
- DDoS attacks or network disruption
- Unauthorized access to systems or networks
- Cryptocurrency mining without prior approval
- Port scanning or vulnerability testing without permission
- Resource abuse causing server degradation
- Proxy services or VPN services without approval
5.3 Resource Usage
Shared hosting accounts are subject to fair usage policies. Excessive resource consumption may result in service suspension or upgrade requirement. VPS and dedicated servers have defined resource limits as per the service plan.
5.4 Violations
Violation of this Acceptable Use Policy may result in immediate service suspension or termination without refund. We reserve the right to remove content and take necessary actions to protect our infrastructure and other customers.
6. Service Level Agreement (SLA)
6.1 Uptime Guarantee
Bloom Hosting guarantees 99.9% uptime on all shared, VPS, and dedicated hosting plans. Uptime is calculated monthly excluding scheduled maintenance.
6.2 Scheduled Maintenance
We reserve the right to perform scheduled maintenance with at least 24 hours notice. Emergency maintenance may be performed without notice when necessary to protect the integrity of our systems.
6.3 SLA Credits
If we fail to meet our uptime guarantee, you may be eligible for service credits:
- 99.0% - 99.8% uptime: 5% credit
- 98.0% - 98.9% uptime: 10% credit
- Below 98.0% uptime: 25% credit
Credits must be requested within 7 days of the incident and are applied to future invoices only.
7. Support & Maintenance
7.1 Support Availability
Technical support is available 24/7/365 via:
- Support ticket system (all customers)
- Live chat (business hours)
- Email support (response within 24 hours)
- Phone support (VPS, dedicated, and enterprise customers)
7.2 Support Scope
Our support covers:
- Server configuration and optimization
- Control panel assistance
- Basic troubleshooting
- Account and billing inquiries
Support does not include custom coding, application development, or third-party software troubleshooting.
7.3 Backups
While we perform regular backups, you are responsible for maintaining your own backups. We do not guarantee data recovery and are not liable for data loss.
8. Termination
8.1 Termination by Customer
You may cancel your services at any time through your account dashboard or by contacting support. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months.
8.2 Termination by Bloom Hosting
We may suspend or terminate your account immediately if you:
- Violate these Terms of Service
- Fail to pay for services
- Engage in fraudulent activities
- Cause harm to our infrastructure or other customers
8.3 Data Retention
Upon termination, your data will be retained for 14 days for shared hosting and 30 days for VPS/dedicated servers. After this period, all data will be permanently deleted.
9. Limitation of Liability
To the maximum extent permitted by law:
- Bloom Hosting is not liable for any indirect, incidental, special, or consequential damages
- Our total liability is limited to the amount you paid for services in the past 12 months
- We are not responsible for loss of data, profits, or business interruption
- We make no warranties regarding third-party services or content
9.1 Indemnification
You agree to indemnify and hold Bloom Hosting harmless from any claims, damages, or expenses arising from your use of our services or violation of these Terms.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified Terms.
Material changes will be communicated via email to the address on file. We encourage you to review these Terms periodically.
11. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of San Francisco County, California.
